1.3 Limitations This summary report: has been prepared by GHD for Heritage Minerals Pty Ltd and may only be used and relied on by Heritage Minerals Pty Ltd for the purpose agreed between GHD and Heritage Minerals Pty Ltd as set out in Section 1.1 of this report. GHD otherwise disclaims responsibility to any person other than Heritage Minerals Pty Ltd arising in connection with this report. GHD also excludes implied warranties and conditions, to the extent legally permissible. The services undertaken by GHD in connection with preparing this report were limited to those specifically detailed in the report and are subject to the scope limitations set out in the report. The opinions, conclusions and any recommendations in this report are based on conditions encountered and information reviewed at the date of preparation of the report. GHD has no responsibility or obligation to update this report to account for events or changes occurring subsequent to the date that the report was prepared. The opinions, conclusions and any recommendations in this report are based on assumptions made by GHD described in this report (refer section(s) 6 of this report). GHD disclaims liability arising from any of the assumptions being incorrect. GHD has prepared this report on the basis of information provided by Heritage Minerals Pty Ltd and others who provided information to GHD (including Government authorities)], which GHD has not independently verified or checked beyond the agreed scope of work. GHD does not accept liability in connection with such unverified information, including errors and omissions in the report which were caused by errors or omissions in that information. GHD has prepared the GoldSim model (“Model”) for, and for the benefit and sole use of, Heritage Minerals Pty Ltd to support assessment of simulated mine water inventory and must not be used for any other purpose or by any other person. The Model is a representation only and do not reflect reality in every aspect. The Model contains simplified assumptions to derive a modelled outcome. The actual variables will inevitably be different to those used to prepare the Model. Accordingly, the outputs of the Model cannot be relied upon to represent actual conditions without due consideration of the inherent and expected inaccuracies. Such considerations are beyond GHD’s scope. The information, data and assumptions (“Inputs”) used as inputs into the Model is from publicly available sources or provided by or on behalf of Heritage Minerals Pty Ltd, (including possibly through stakeholder engagements). GHD has not independently verified or checked Inputs beyond its agreed scope of work. GHD’s scope of work does not include review or update of the Models as further Inputs becomes available. The Model is limited by the mathematical rules and assumptions that are set out in the Report or included in the Model and by the software environment in which the Model was developed. The Model is a customised model and not intended to be amended in any form or extracted to other software for amending. Any change made to the Model, other than by GHD, is undertaken on the express understanding that GHD is not responsible, and has no liability, for the changed Model including any outputs.
