H12 Where an operational plan covers decommissioning and rehabilitation, those operations are to be consistent with the design plan for the dam and the rehabilitation requirements of this environmental authority.
The EA holder does not currently manage or maintain regulated dams. Once applicable, an operational plan will be kept current for each regulated dam which complies with condition H12. Once applicable, the administering authority will be notified if dams reach the MRL. Upon commencement of mining, the EA holder will become responsible for managing and maintaining regulated dams, and will ensure that all regulated dams are inspected annually by a suitably qualified and experienced person. Once applicable, the inspection will include assessment of the condition and adequacy of each regulated dam against the appropriate structural, geotechnical and hydraulic performance criteria. When the EA holder takes responsibility for management of dams, the MRL of each regulated dam will be clearly marked and maintained. An assessment of the adequacy of available storage of each regulated dam will be determined based on the requirements and time periods set out in condition A3 and H17. Once regulated dam inspection reports are required of the EA holder, two copies of a certified inspection report will be provided to DES. The inspection report will include recommendations to be taken. When the EA holder takes responsibility for the management of damns, condition H19 will be complied with in full. Recommendations in the annual inspection report will be implemented no longer than one month after receiving it, to ensure dam safety.
H13 The licensee must notify the administering authority as soon as possible, but within twenty-four (24) hours, of the level in any regulated dam reaching the mandatory reporting level (MRL) and must immediately act to prevent or minimize any actual or potential environmental harm.
Regulated dams – annual inspection and report H14
Each regulated dam must be inspected annually by a suitably qualified and
experienced person .
H15 At each annual inspection, the condition and adequacy of each regulated dam must be assessed for dam safety and against the necessary structural, geotechnical and hydraulic performance criteria .

At each annual inspection, if a mandatory reporting level is required, it must be
determined and marked on each regulated dam .
H17 A final assessment of adequacy of available storage in each regulated dam must be based on a dam level observed within the month of October and result in an estimate of the level in that dam as at 1 November . For each annual inspection, two copies of a report on the condition and adequacy of each regulated dam, certified by the suitably qualified and experienced person and including any recommended actions to be taken to ensure the integrity of each regulated dam; must be provided to the administering authority by 1 December . H18 H19 The licensee must, within one week of receipt of the annual inspection report, consider the report and its recommendations; and as soon as possible, but within one month of receipt of the annual inspection report, formulate and implement actions to ensure that each regulated dam safely performs its intended functions .
